My mom lives in Minneosta and her employer told her that she has to make up the time that she takes off to vote in the election tomorrow. I think this is illegal. I think that the employer has to give her the paid time off! Yep, it's illegal, as long as she votes in the morning.
Here's the exact law:
Minnesota Statute 204C.04 EMPLOYEES; TIME OFF TO VOTE.
Subdivision 1.Right to be absent. Every employee who is eligible to vote in an election has the right to be absent from work for the purpose of voting during the morning of the day of that election, without penalty or deduction from salary or wages because of the absence. An employer or other person may not directly or indirectly refuse, abridge, or interfere with this right or any other election right of an employee.
And here's Subdivision 3:
Penalty.
A person who violates this section is guilty of a misdemeanor, and the county attorney shall prosecute the violation.Is it illegal for my mom's employer to make her make up the time she takes off of work to vote?
No law requires paid time off to vote. Many companies do it as a matter of policy, and many employees have contracts that allow for time off, either negotiated individually or by a union, but no law requires it in any state.
Is your mother is working the entire time the polls are open? If she knew she would not be able to make it to the polls on election day, why not vote early?
You vote on your own time. The polls open early and close late.
Does she stop at the convenience store on the way to or from work? Does she get paid for that? I hardly think so.
No, it is not illegal. This is why election day should be moved to a Sunday.
I think she should be docked since it can take abt 5 min to 6 hours depending where u are. There are places open early and late so she should do this before or after. It should not be the responsibility of the employer to pay you to vote since we are entering a recession and your mom may loose her job soon.
So, If I were your mother, I wouldnt argue the case, I would go early or after work. Its shouldnt be on company time.
